1. Who we are

These Terms and Conditions govern the use of our website and the purchase of digital products through it. By placing an order, you agree to them.
2. Definitions
- Store — the website smagapaperwood.com operated by us.
- Customer / you — anyone using the Store or placing an order, whether a consumer or a business.
- Consumer — a customer who is a natural person making a purchase not directly related to their business or professional activity, within the meaning of Polish and EU consumer law.
- Product — a digital template (PDF and/or SVG files, and any accompanying instructions) offered for sale in the Store.
- Order — a declaration of intent to purchase a Product, submitted through the Store.
3. What we sell
All Products in the Store are digital content supplied in a non-tangible form — downloadable files, not physical goods. No physical item is shipped for any order. Product descriptions (dimensions, sheet count, build time, difficulty level, and paper recommendations) refer to the finished piece a customer builds themselves, not to the file.
4. Placing an order
- Add the Product(s) you want to your cart and proceed to checkout.
- Provide the required billing details (name, email, billing address) [and account details, if applicable].
- Choose a payment method and complete payment.
- Before finalising the order, you will be shown a summary of the Product(s), the total price including VAT, and these Terms, for your confirmation.
- Once payment is confirmed, your order is accepted and the digital files are made available to you as described in section 6.
Placing an order requires an internet connection, a valid email address, and software capable of opening PDF and/or SVG files (details in each Product’s description).
5. Prices and payment
All prices shown in the Store are in EUR and include VAT where applicable. We reserve the right to change prices for Products not yet ordered; the price at the time you place your order is the price you pay.
Accepted payment methods: credit/debit card, BLIK, PayPal, Google Pay, Apple Pay, bank transfer via Stripe. Stripe processes payment, and its own terms and privacy practices also apply to that step.
6. Delivery of digital content
Because our Products are digital downloads, there is no physical shipping. Once payment is confirmed, you will receive:
- a confirmation email, and
- access to download your files, either via a direct download link, an email attachment, or your account’s order history [confirm which applies].
Digital delivery is provided immediately after successful payment, unless a Product page states otherwise. Please ensure your billing email address is entered correctly, as this is where delivery and order communications are sent.
7. Right of withdrawal — and why it doesn’t apply once you download
Consumers in the EU normally have a 14-day right to withdraw from an online purchase without giving a reason, under the Consumer Rights Directive (2011/83/EU) as implemented in Poland.
This right does not apply to our Products once delivery has begun, because our Products are digital content not supplied on a tangible medium. Under Article 16(m) of the Directive (and the corresponding provision of Polish law), this exception applies only where:
- you have given explicit prior consent to us beginning performance (delivery) before the 14-day withdrawal period ends, and
- you have acknowledged that you lose your right of withdrawal once that delivery begins.
At checkout, you will be asked to confirm both of these points via a clear checkbox before your order is completed. Once you tick that box and complete payment, your right of withdrawal ends as soon as the download becomes available to you.
If you do not give this consent, we will not be able to deliver the digital files, since delivery would otherwise need to wait until the withdrawal period has passed.
Where a right of withdrawal does apply (for example, if consent was not validly obtained), you may exercise it via “the electronic form linked here” or “emailing us at hello@smagapaperwood.com in line with applicable EU requirements for an accessible, electronic withdrawal mechanism.
8. Licence to use what you buy
Purchasing a Product gives you a licence to use the files as described in our Licence FAQ, currently summarised as:
- Personal use is included with every purchase.
- Commercial use — selling finished pieces you make by hand — is included, with credit to Smaga Paperwood, up to a normal handmade scale.
- Larger-scale or manufactured production requires separate arrangement with us.
- The template files themselves may not be shared, resold, or redistributed, whether for free or for payment.
This licence is personal to the purchasing customer and does not transfer Product files to any third party.
9. Your responsibilities
You agree to:
- provide accurate information when ordering;
- use the Products in line with the licence terms in section 8;
- not attempt to share, resell, or redistribute the Product files;
- not use the Store for any unlawful purpose.
10. Complaints and non-conformity (Reklamacje)
If a Product is faulty — for example, a corrupted file, missing pages, or content that doesn’t match its description — you have the right to make a complaint. Digital content we supply must be fit for purpose, of satisfactory quality, and match its description, in line with Polish and EU digital-content conformity rules.
To make a complaint, email us at hello@smagapaperwood.com with your order number and a description of the issue. We will respond within 14 days. Depending on the situation, we will offer a corrected file, a replacement, or — where the issue can’t reasonably be fixed — a refund.
This complaints procedure is separate from, and does not replace, your statutory rights.
11. Out-of-court dispute resolution
If you are a consumer and we can’t resolve a complaint directly, you may use:
- the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr
- mediation or assistance from your local consumer ombudsman (Rzecznik Praw Konsumenta) or the Polish Trade Inspection (Inspekcja Handlowa).
Using these options is voluntary and does not affect your right to pursue a claim in court.
12. Intellectual property
All Product designs, text, images, and the Store’s own content are the intellectual property of Smaga Paperwood Smaga Monika Smaga, protected by copyright. Purchasing a Product grants the licence described in section 8; it does not transfer ownership or copyright of the design itself.
13. Liability
We provide our Products with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of our Products (for example, cost of materials used in an attempted build). Nothing in these Terms limits any liability that cannot be limited under Polish or EU consumer law, including liability for non-conforming digital content.
14. Business customers
If you are purchasing as a business rather than a consumer, some consumer-protection provisions above (in particular the withdrawal-right provisions in section 7) may not apply to you in the same way; the licence terms in section 8 and payment terms still apply.
15. Personal data
Personal data is processed in line with our Privacy Policy, which explains what we collect, why, and your rights.
16. Changes to these Terms
We may update these Terms from time to time — for example, to reflect a change in our tools, our licence terms, or the law. The current version is always available on this page, with the “last updated” date at the top. Changes do not apply retroactively to orders already placed.
17. Governing law
These Terms are governed by Polish law. Consumers resident in another EU member state also benefit from any mandatory consumer-protection provisions of their own country’s law that cannot be excluded by agreement.
